Az európai uniós légiutas-kompenzáció jogi természete és magyarországi jogérvényesítési modellje

The study examines the legal nature and enforcement model of air passenger compensation under Regulation (EC) No 261/2004 in light of the case law of the Court of Justice of the European Union, Hungarian judicial practice and constitutional review. The analysis focuses on the relationship between compensation under the Regulation and the traditional private law concepts of damages and compensation, as well as on the way in which the functional characteristics of the institution have influenced its enforcement model. The paper argues that the objective, normative and preventive features of compensation can only be partially explained within the framework of classical private law categories. Based on the development of EU and Hungarian case law, the study identifies a sui generis legal institution in which individual claims are increasingly interconnected with the public-interest and public-authority logic of consumer protection enforcement.

Abstract

The analysis focuses on the relationship between compensation under the Regulation and the traditional private law concepts of damages and compensation, as well as on the way in which the functional characteristics of the institution have influenced its enforcement model. The paper argues that the objective, normative and preventive features of compensation can only be partially explained within the framework of classical private law categories. Based on the development of EU and Hungarian case law, the study identifies a sui generis legal institution in which individual claims are increasingly interconnected with the public-interest and public-authority logic of consumer protection enforcement.
