Az elvárható gondosság követelményének értelmezése az aneszteziológiai és intenzív terápiás ellátások területén a joggyakorlat alapján
Anaesthesiology and intensive care medicine raise particularly important questions of liability due to the vulnerability of patients and the time-critical, complex nature of clinical decision-making. Drawing on an inductive analysis of relevant case law, this study examines the recurring issues that may give rise to liability in this field, as well as the circumstances that may exempt healthcare providers from liability. The case law demonstrates the particular importance of appropriate pre-procedural preparation, risk assessment, timely and adequate patient information, and accurate documentation. Accordingly, the standard of due care cannot be reduced to mere formal compliance with professional rules, but must be assessed in light of the specific circumstances of each individual case.
