Do Nascituro ao Concepturo: A Autonomia Conceitual do Embrião Ex-Vivo no Direito da Saúde

The concept of life beginning at fertilization has met with resistance in the legal sphere due to the possibility of creating embryos in the laboratory that depend on their future and uncertain implantation in the uterus. It is necessary to analyze legal concepts in light of this new reality in order to distinguish non-implanted embryos from those located within the human body. This bibliographic and documentary article, adopting a theoretical and critical perspective, aimed to distinguish the concepts within genetic-developmental theory. The thesis that an embryo outside the female reproductive system is classified as a conceptus rather than an unborn child has been shown to be scientifically and legally correct, thereby highlighting the impropriety of legislative proposals that seek to equate both stages.
