Direito à Saúde da Criança e Custeio de Tratamento no Exterior

Objectives: to analyze the limits of public funding for pediatric treatment abroad in light of children's absolute priority and the existence of an alternative within the SUS. Methods: qualitative, bibliographic and documentary research focused on REsp 1,860,543/PR and health regulations, examined through content analysis and the hermeneutic-concretizing method. Limitation: the study is based on a single recent precedent and does not empirically assess its subsequent application. Results: absolute priority strengthens the State's duty but does not guarantee access to the most renowned foreign center. Conclusions: exceptional funding requires inadequacy of the national alternative, efficacy and safety, clinical indispensability and financial incapacity.
