INTERACTION BETWEEN PLATFORM RELATIONSHIP PARTICIPANTS: THE STRUCTURE OF CONTRACTUAL RELATIONS
The platform economy is one of the main areas of development in the context of digitalization of turnover, but there is currently no consensus on the legal nature of a number of contracts that mediate platform relations. Using general scientific (analysis, induction, and deduction) and special legal (formal legal and comparative legal studies) methods, it was established that the structure of contractual relations becomes more complex in relationships involving digital platforms. To ensure interaction between sellers, performers, buyers, and customers, it is necessary to provide access to information resources and maintain their functionality and updating. The interaction of platform participants is mediated by various contracts (a contract for the operation of an intermediary digital platform, a contract for the interaction of the operator of an intermediary digital platform with partners or owners of order pick-up points, as well as contracts that provide access to the digital platform). It has been proven that the contracts that provide access to the digital platform are service contracts by their legal nature, and they should be distinguished from license contracts concluded for specific results of intellectual activity. Based on the conducted research, it has been substantiated that all of the listed contracts, as well as the contracts concluded on the platform between users and partners (in particular, contracts of sale and purchase, contracts of employment, etc.), on the one hand, are independent, but on the other hand, their terms are interconnected and cannot be interpreted discretely, which means that the emerging contractual relations form a complex structure, representing an interconnected network of contracts (a network contract)
