In its ruling, the Curia examined whether the judicial review of a decision of the general assembly of the Hungarian Academy of Sciences regarding the transfer of the Academy's assets falls within the competence of an administrative or a civil court. The Curia pointed out that, pursuant to the provisions of a separate act of parliament, jurisdiction to adjudicate legal disputes between a statutory public body and its members falls within the competence of administrative courts. Given that in the present case it was a member of the Hungarian Academy of Sciences who challenged the general assembly's resolution, the Curia concluded that the administrative court had the authority to exercise judicial review over said resolution.
