Quando a prescrição encontra o Judiciário: evidências científicas e os limites da decisão judicial no custeio de terapias multidisciplinares para pessoas autistas

The judicialization of multidisciplinary therapies for autism has become a structural phenomenon in Brazil, generating an epistemic conflict between intensive medical prescriptions, scientific evidence, and case law. This study investigates how the judiciary should balance its decisions without compromising the rationale behind them or hindering access to healthcare. To achieve this objective, a qualitative, exploratory, and hypothetical-deductive research approach was adopted. It is concluded that judicial legitimacy requires the standardization of court orders, establishing clinically justifiable treatment schedules, measurable goals, periodic reassessments, and opinions from technical committees, thereby overcoming both blind approval and formalistic denial by health insurers and the State.
