Oversight And Governance Dynamics: Analysing The National Council Of Provinces (NCOP) Role In The Passage Of The National Health Insurance Bill (NHI) In South Africa

The National Council of Provinces (NCOP) has conducted oversight over the National Health Insurance (NHI) Bill to understand the positions of provincial legislatures on the bill across South Africa. Through this, the NCOP has reached a consensus to pass the Bill. The NCOP’s decision to pass the Bill was applauded by the government. However, from the Functionalist theory of Oversight perspective, the NCOP's decision to pass the NHI bill raises concerns about the effectiveness and thoroughness of the NHI bill oversight process. It is in this context that this research paper aimed to analyse the oversight role of the NCOP in the passage of the NHI bill to determine whether the NCOP was effective in executing its oversight role. The Functionalist Theory of Oversight and Q&A approach to legislative oversight were employed as two tools of analysis for this paper. This paper employed qualitative research methodology using documentary review as the central data collection method. The paper critically analysed data from a range of sources, such as NCOP minutes, research papers, government updates and media reports. To analyse and present the paper's findings, thematic content analysis was effectively employed. The paper finds that that NCOP was effective in conducting oversight over the NHI bill in the sense that committee members in the NCOP asked relevant questions and managed to extract more information from the Department of Health. In contrast, the NCOP was ineffective in conducting oversight on the NHI bill in the sense that they were unable to compel the Department of Health to consider changing the course of action regarding the NHI bill despite some key raising critical issues affecting some sections of the bill in conducting oversight over the NHI bill on some functions. Finally, this paper recommends reforms within parliament to allow committees and its members to conduct their oversight role effectively in all functions outlined in this paper.
