Entre o Soft Law e a Responsabilidade Internacional: Due Diligence Algorítmica na Governança Transnacional da IA
This article examines algorithmic due diligence as a legal-operational category for international artificial intelligence governance. Through qualitative, bibliographic and documentary research, it addresses digital sovereignty, regulatory fragmentation, the EU AI Act, the Council of Europe Framework Convention and international due diligence guidance. It concludes that algorithmic due diligence does not eliminate AI’s jurisdictional fragmentation, but may strengthen duties to identify, prevent, mitigate, monitor and respond to foreseeable risks, turning preventive care into a legal criterion for assessing the conduct of States and private actors.
