INDIVIDUAL PROBLEMS OF RECOGNITION OF SMART CONTRACTS AS TRANSACTIONS

This article is devoted to the study of individual problems of the legal recognition of smart contracts as transactions. The main goal. To highlight the problems of the possibility of extending the classical doctrine of transactions to relations related to smart contracts. The problems under consideration: the legal features inherent in transactions in the form of smart contracts, namely: the presence of signs inherent in a real transaction; the allocation of benefits at the time of transfer from the power of both the seller and the buyer; the presence of significant power on the side of the developer of smart contracts. Conclusions: the possibilities of using smart contracts as legal means of countering invalid transactions through preventive detection of defects are analyzed.
