Disputed Utility Charges, Unresolved Consumer Objections and Repeated Debt-Collection Messages in Latvia: An Evidence-Based Legal Case Study

Abstract This evidence-based legal working paper examines disputed utility charges, unresolved consumer objections, debt-collection practices and repeated SMS communications involving SIA “Baložu Komunālā Saimniecība”, SIA “Ķekavas nami” and SIA “PAUS KONSULTS” in Latvia. The documented dispute concerns a EUR 55.18 principal balance, a contested EUR 8.20 late-payment charge, an alleged inconsistency with a publicly announced suspension of certain late-payment charges, and a reported EUR 15 debt-collection cost. The study investigates whether the relevant service providers and collection agents adequately examined the consumer's written objections, substantiated the amounts claimed, corrected any billing errors and ensured that subsequent collection communications were accurate, transparent and proportionate. The analysis addresses Latvian consumer protection and out-of-court debt recovery law, Directive 2005/29/EC on unfair commercial practices, Directive 93/13/EEC on unfair contract terms, Regulation (EU) 2016/679 (GDPR), and the conditions governing effective legal remedies under EU law. Particular attention is given to the distinction between requesting discretionary debt reduction and demanding correction of charges lacking a demonstrated legal or factual basis. The accompanying documentary compilation includes corporate financial records, correspondence, objections and SMS evidence. The paper identifies evidentiary limitations, alternative explanations and questions requiring independent examination. Principal conclusion: Consumer protection requires a verifiable reconciliation of disputed charges and a reasoned response to objections. Repeated payment reminders should not substitute for substantive investigation of a contested account. Publication status: Independent legal working paper; not peer reviewed. Allegations and unresolved questions are not presented as established judicial findings.
