Cryptographic Labeling of Tactical Disinformation: Possibilities for Fixation and Procedural Limits

The article examines the procedural and technical conditions for the cryptographic marking of tactical disinformation in criminal proceedings. Its empirical basis consists of a survey of 41 legal professionals: 10 investigators and inquiry officers, 13 judges, and 18 defense lawyers. The responses reveal the use of tactical methods, differing views on their permissibility, and support among some respondents for clearer procedural safeguards. The article proposes a model for recording, before a tactic is used, the person responsible, the grounds for its use, its content, and its limits, using hashing and an electronic signature. Such a record could facilitate subsequent verification of its integrity and of the circumstances in which the decision was made. The survey does not establish the models technical effectiveness, and the cryptographic integrity of a record does not, in itself, determine whether the tactic is lawful.
