THE NATURE OF LEASE RIGHTS AS A TYPE OF PROPERTY RIGHT
This article examines the place of lease rights within the system of property rights and their civil-law nature. It analyzes the relationship between possession and use under a lease agreement, the possibility of granting a right of use alone, and the legal positions of owners and lessees. Scholarly approaches to the relative nature of lease rights and their certain proprietary characteristics are considered alongside commercial and social residential tenancies and the determination of rent. Particular attention is given to the protection of tenants’ interests and the balance between the parties’ rights. Proposals are advanced to improve Articles 600, 605 and 611 of the Civil Code of Uzbekistan by clarifying the scope of residential tenancy rights, the landlord’s obligations and rent-setting rules. Keywords: lease rights, property rights, lease agreement, possession, right of use, residential tenancy, tenant, ownership.
