CRÍTICAS AO USO DA INTELIGÊNCIA ARTIFICIAL NO PODER JUDICIÁRIO: ENTRE A EFICIÊNCIA TÉCNICA E A JURISPRUDÊNCIA VIRTUOSA
The Judiciary, like all other state institutions, has been overtaken by a growing demand for technical improvement in pursuit of efficiency at any cost. In this context, various software applications have come into use in judicial practice, ranging from access to electronic case files to judicial decision-making using artificial intelligence. However, this scenario, which reduces lawyers, court staff, and judges to mere intermediaries within a self-sufficient system for managing court filings and decisions, has distanced those seeking judicial protection from virtuous adjudication—an approach that places at the heart of decision-making the recognition that judicial proceedings concern not numbers, but human lives. This calls for a critical literature-based study to identify alternatives for mitigating the displacement of the human role by technique in the judiciary and to assess the impacts of the current situation. The findings indicate that technique, with self-growth as one of its foundations, has ultimately subsumed the whole of legal reasoning under its own logic. Within this logic, delays in adjudication are automatically equated with injustice, and technical support for swift decisions is deemed preferable, regardless of the consequences and the human lives behind the case files.
