A urgência de uma governança ambiental transnacional׃ uma abordagem centrada na política da agenda climática global

In this paper, we propose a reflection on transnational climate governance as a mechanism for implementing sustainable development. However, the paper discusses the current international system’s inability to articulate concrete public policies capable of dealing with the climate change scenario. From a methodological point of view, the research developed an interdisciplinary bibliographic review, conceiving a holistic dialogue between theoretical perspectives centered on the climate agenda (environmental governance), international public policy and environmental law. The results of the study focused on the criticism of the concept of national borders and their respective jurisdictions, as they have proven inadequate to develop effective models of public policies and regulatory guidelines aimed at consolidating the climate agenda, considering that the biosphere constitutes a unique and interconnected system, transcending the administrative borders of countries. Finally, the research highlights the ineffectiveness of public international law in addressing environmental impacts, since it lacks binding force and remains dependent on the unilateral wills of states, and above all, on the dynamics of the conflicts of government cycles.
