Digitalization of the International Legal Sphere: Systemic Challenges And Prospects for the Evolution of International Law
This article examines the digital transformation of international law as a multidimensional process of rethinking traditional mechanisms of international interaction. It is argued that the penetration of digital technologies into the sphere of international legal regulation leads not only to the emergence of new objects of legal protection but also to the transformation of established approaches to determining state jurisdiction, enforcing international responsibility, and ensuring compliance with international obligations. The paper identifies the key challenges of the digital age for international law, including the fragmentation of international regulation of the digital environment, the asymmetry of states’ technological capabilities, the complexity of establishing liability for cross-border digital offenses, and the need to harmonize cybersecurity requirements with international human rights standards. The study emphasizes that the effectiveness of international legal regulation increasingly depends on the ability of international institutions and states to ensure the interaction of universal legal principles with flexible mechanisms for responding to technological risks without undermining guarantees of human rights, state sovereignty, and international security. Promising directions for legal development are outlined, including the improvement of international standards for digital governance, the formation of coordinated approaches to international legal liability for the use of digital technologies, the strengthening of international cooperation in the field of cybersecurity, and the development of regulatory mechanisms to oversee the use of artificial intelligence. The paper demonstrates the advisability of transitioning from a piecemeal response to individual technological threats to a systematic model of international legal regulation based on the principles of coherence and respect for fundamental human rights. It is concluded that the digital transformation of international law represents not only a technology-driven challenge but also an opportunity to renew its normative potential, institutional capacity, and instruments for ensuring the international legal order in the context of global digital interdependence.
