«International Law of the Ancient Period»

The article under studies is the second part of the publication dedicated to the scientific legacy of Ion Turсanu on the history of international law, which contains a translation of his work and introduces it into Ukrainian-language scientific discourse for the first time. This part highlights the peculiarities of the formation and development of the legal foundations of inter-state relations in Ancient Greece and Ancient Rome, as well as the historical forms and mechanisms for regulating interaction between political entities of the ancient world. In terms of I. Turсanu’s scientific views, the article regards the activities of inter-polis associations (in particular, amphictyonies and symmachies), the practice of concluding international treaties, the institutions of proxeny and arbitration, the legal status of foreigners, and the customs of warfare in the Hellenic world. Particular emphasis has been laid on the Roman jus fetiale and jus gentium, the legal aspects of declaring war and concluding international treaties, guarantees of diplomatic immunity for envoys, as well as the transformation of inter-state relations under the influence of Rome’s growing political hegemony. Appealing to I. Turсanu’s scientific legacy enables the scholars to trace up the tendencies of how ancient international legal institutions were conceptualized in earlier research, as well as to compare these approaches with the outcomes of contemporary studies on the history of international law. The introduction of this work into Ukrainian-language scientific discourse facilitates additional opportunities for historical-legal analysis, critical reconsideration of the already established scientific views, as well as definition of continuity, common and distinct features in interpreting the origins of international legal norms and institutions. Thus, the publication contributes to the preservation and dissemination of I. Turсanu’s scientific legacy, the expansion of the source and historiographical basis of modern research, and the promotion of understanding the historical prerequisites for the formation of international law.
