Methodology for the Legal Assessment of Technology Readiness Based on the Concept of Legal Engineering

The paper examines the development of a methodological framework for assessing the legal readiness of technologies. In the context of digital transformation and the pursuit of technological leadership, conventional approaches to assessing technological maturity reveal significant limitations, as they fail to account for legal factors affecting the successful commercialization of innovations. The study substantiates the need to integrate the technology readiness assessment methodology set forth in the national standard GOST R 71726-2024 with the concept of legal engineering, an interdisciplinary methodology aimed at incorporating legal mechanisms into the management of technology projects. The paper proposes a legal readiness scale comprising a nine-level system of indicators for assessing a technology's legal readiness. It also sets out methodological approaches to legal assessment at different stages of a technology's life cycle, including patent research, regulatory-readiness assessment, and intellectual-property management. Particular attention is devoted to such legal-engineering instruments as the design of experimental legal regimes and the implementation of the Legal-by-Design principle, which entails embedding legal requirements at the technology-design stage. The findings may be applied to the organization of technology transfer, the implementation of innovative products, and the formulation of technology policy.
