Pengecualian Informasi dalam Sistem Registri Unit Karbon

The Carbon Unit Registry System (SRUK) establishes transparency as a characteristic of registry administration while also recognizing categories of exempt information, creating questions about the limits of public access to information that may have environmental, commercial, personal, or contractual characteristics. The issue requires legal analysis because public information disclosure is not absolute and exemptions must be situated within the framework of legally protected interests. This study aims to analyze the status and limits of information exemptions in the SRUK under Indonesia’s public information disclosure law. The study employs normative legal research using statutory and conceptual approaches to harmonize SRUK provisions with the regimes governing public information disclosure, trade secrets, and personal data protection. The analysis finds that SRUK information cannot be treated as automatically public or confidential; its status and accessibility must be determined according to the characteristics of the information and the relevant legal basis for protection. Categories such as commercial information, confidential information, buyer data, transaction prices, and contractual documents do not in themselves produce automatic confidentiality, while the environmental value and public interest in carbon-market integrity must be considered when testing restrictions. The analysis underscores the importance of classification, exemption testing, possible partial disclosure, and objection and information-dispute mechanisms. The study concludes that the limits of SRUK information exemptions should be determined through harmonization between sectoral transparency obligations and the public-information exemption regime, rather than through confidentiality labels alone.
