Consumer Protection in Islamic Law: A Thematic Hadith Analysis of Khiyar and Its Contextualization in the Digital Era

This study aims to analyze hadiths on khiyar as a basis for consumer protection in Islamic law and examine their relevance to digital transactions. The study employs a normative legal method with a descriptive-analytical qualitative approach through library research. The data are drawn from hadiths on khiyar in hadith collections and relevant fiqh literature. The analysis involves tracing hadith sources (takhrij), examining their wording and key vocabulary (mufradat al-hadith), and analyzing the concepts and types of khiyar in Islamic commercial jurisprudence (fiqh muamalah). The findings show that the hadiths reported in Sahih al-Bukhari No. 2112 and Sahih Muslim No. 1531 explain the right of choice in sales transactions and the circumstances under which a contract becomes binding. Fiqh literature also reveals differences among scholars regarding the rules governing khiyar, particularly its time limits and application. In the digital context, the principles of khiyar are conceptually relevant to order cancellation features and return policies, particularly in promoting transparency, fairness, and the protection of consumer rights. However, their application requires consideration of the characteristics of digital transactions, fiqh principles, and applicable regulations. This study concludes that khiyar can serve as a normative foundation for examining digital consumer protection from the perspective of Islamic law.
