Kedudukan Hukum Kuota Internet sebagai Objek Hak Konsumen dan Kewajiban Operator Telekomunikasi Pasca Putusan Mahkamah Konstitusi Nomor 273/PUU-XXIII/2025

The expiry of unused internet data quota when a package’s validity period ends raises a legal problem, because consumers have already paid for service benefits that they have not fully used. Constitutional Court Decision Number 273/PUU-XXIII/2025 adds an obligation for telecommunications providers to offer service options that keep users’ remaining quota active and usable. This study analyses the legal status of internet data quota as intangible property under Indonesian civil law, the change in operators’ obligations to protect remaining quota, and the implications of the decision for telecommunications service agreements. It is normative juridical legal research that uses statute, conceptual, case, and analytical approaches, with qualitative-prescriptive analysis. The findings show that data quota has economic value, can be measured quantitatively, and can become the object of a legal dispute, so it can be constructed as intangible property, a construction reinforced by the Court’s reasoning. Before the decision, protection of remaining quota derived from the principle of good faith, consumer protection law, and sector regulation. After the decision, operators must provide service options that guarantee remaining quota stays usable, while retaining discretion over the technical mechanism. The decision does not abolish freedom of contract but limits it, so a validity-period clause cannot justify the unilateral loss of the benefit of remaining quota. The study concludes that protection of remaining quota is now part of operators’ legal obligations, and operators need to adjust their product design and service agreements accordingly.
