Crime Against Juveniles with Special Reference to the Protection of Children from Sexual Offences Act, 2012 and the Juvenile Justice (Care and Protection of Children) Act, 2015

Crime against juveniles has emerged as a grave concern in India, raising critical questions about the safety, rights and dignity of children in a rapidly transforming society. Juveniles, due to their age are emotionally vulnerable and dependent and also become victims of offences including physical abuse, sexual exploitation, human trafficking, cybercrime and child labour etc. These crimes also have long-term psychological, social and developmental impacts on them. This research critically examines the effectiveness of legal mechanisms in addressing the growing complexity of crimes against children. This paper undertakes a comprehensive review of national and international legal frameworks addressing juvenile protection, including the protection of Children from Sexual Offences (POCSO)Act,2012, as well as the Juvenile Justice (care and Protection of Children) Act, 2015. Despite this, this research also highlights critical gap in implementation, such as delay in investigation, poor inter-agency coordination as well as a lack of understanding the overlap between the POCSO Act and the Juvenile Justice Act. A qualitative and quantitative research methodology is employed, including case studies and data analysis from cybercrime reports. This study examines real-world instance of crime and evaluates preventive measures taken by the government. This research contributes to the growing field of criminology against juvenile crime and suggesting stronger regulatory measures.
