Reforming The Enforcement Of Post-Divorce Maintenance Orders: A Comparative Study Of Indonesia And The United States

This study aims to analyse the limitations in the enforcement of post-divorce maintenance orders in Indonesia and to propose a legal reform through the limited adoption of the civil contempt mechanism from the United States. Employing a normative legal methodology with a statutory and comparative law approach, this study examines primary and secondary legal sources. The results of the analysis indicate that the problem in Indonesia is not the complete absence of legal instruments, but rather the lack of adequate noncriminal enforcement instruments for periodic claims, as well as the weaknesses of passive enforcement based on executorial beslag. Through a comparative normative analysis, it was found that the doctrine of civil contempt in the United States provides compliancebased enforcement instruments, such as conditional coercive detention orders, wage garnishment and the suspension of administrative licences, which can be adapted into religious civil procedure law whilst taking into account the limitations of the national legal system and the principles of Maqasid al-Shariah. This research contributes a model for normative legal reform to strengthen the effectiveness of post-divorce rights enforcement in Indonesia.
