Considerazioni critiche sui primi passi del nuovo processo costituente ungherese (a margine del XVI e del XVII emendamento della Legge fondamentale)

Critical Reflections on the first steps of Hungary’snew constitutional process (in light of the 16th and 17thamendments to the Fundamental Law) This article provides a critical analysis of the first constitutional amendments adopted by the new Hungarian majority that emerged from the ballots on 12 April 2026. In particular, by focusing on two specific measures contained in the 16th and 17th amendments – the introduction of a term limit for the Prime Minister and the early removal of the President of the Republic – the author aims to prove that, despite the intention to pave the way for a new constitutional process to restoring the rule of law following Fidesz’s defeat, there are still several elements of continuity between the past and the present that ought to be resolved in order to start a new chapter of constitutional democracy within Hungary’s borders.
