Automated Administrative Proceedings

The relevance of the topic is driven by the rapid development of information and communication technologies and their integration into public administration. The current domestic legal regulation of automated administrative act adoption is in its infancy. Therefore, comprehensive scientific research into this procedure is required to identify potential conflicts or defective provisions that must be subsequently eliminated. This objective was set by the author of the article and pursued using a range of scientific methods, including logical-semantic, formal-logical, hermeneutic, forecasting, and the method of ascending from the abstract to the concrete. The research resulted in several original definitions formulated by the author, specifically for the concepts of "administrative procedure", "administrative proceedings", and "automated administrative proceedings". "Administrative procedure" is defined as the activity of an administrative body aimed at adopting an administrative act in accordance with statutory provisions. "Administrative proceedings" constitute a unified procedure for performing procedural actions and making procedural decisions, under which administrative bodies adopt administrative acts, essentially carrying out the administrative procedure. "Automated administrative proceedings" refer to the established order of processing administrative case materials using hardware, software, and electronic information systems–conducted either by an official of an administrative body or by dedicated electronic information systems based on algorithms–for the purpose of adopting an administrative act. The article provides a characterization of the features involved in examining and resolving cases in an automated mode, which forms the basis for concluding the existence of certain legislative gaps that warrant further scientific inquiry.
