AI and Judicial Governance: Strategic Imperatives for India

Artificial Intelligence (AI) is reshaping human activities, including when, where, and how such tasks are performed. This paper explores the concept of AI-driven judicial governance, encompassing the use of AI technologies in various aspects of the judicial process - including case management, justice delivery, and law enforcement as well as in areas related to research, documentation, and administrative functions. Reflecting on several governance frameworks, the paper assesses challenges and outlines imperatives for facilitating the responsible introduction of AI into Indian judiciary. AI has significant implications for the Indian judicial system and indeed for countries worldwide: it could address some of the most persistent challenges faced by courts - including excessive backlogs - and therefore, it is important to discuss issues for addressing the challenges arising from such technology.
