The constitutional and legal framework for the institution of human rights monitoring: current assessment

This paper focuses on reviewing the constitutional and legal framework governing the institution responsible for monitoring human rights observance in the modern context. It is found that the principal monitoring body for human rights compliance is the Ukrainian Parliamentary Commissioner for Human Rights, who performs one of the most important parliamentary functions – parliamentary oversight. Due to the rapid development of technology, digitalisation and the emergence of artificial intelligence systems, the number of threats to human rights is increasing. This paper analyses the current constitutional and legal framework governing the Ombudsman’s activities in Ukraine, identifies the levels of legal regulation of the Ombudsman’s status, and highlights certain shortcomings in the regulatory framework. The research outlines tendencies in the development of the institution responsible for monitoring human rights observance under the influence of advances in artificial intelligence systems. It is noted that the Ukrainian Parliament Commissioner for Human Rights could serve as an effective institution for the protection of human rights against contemporary risks, provided that its scope of functions and powers is expanded.
