BEYNƏLXALQ HÜQUQDA “VƏZİFƏLİ ŞƏXS” ANLAYIŞININ İZAHI: YURİSDİKSİYA PROBLEMLƏRİ
The concept of a public official in international law is not specifically defined, that is, there is no consensus regarding this concept in either international legal acts or in international legal doctrine. This, in turn, gives rise to certain theoretical and practical problems, and the immunities and privileges of officials in national legal systems create serious problems in the development of domestic legislation and the application of these rules in legal proceedings regarding the legal status of this category of persons. However, all approaches to this concept have common features. Here we are talking primarily about the issue of jurisdiction, that is, whether a public official is subject to the jurisdiction of a foreign court. It is the clarification of the jurisdiction feature that allows us to clarify whether an official can be held liable as a criminal. As we have already noted, jurisdiction is of particular importance in defining the concept of an official, but it should be noted that a specific definition of criminal jurisdiction is of particular importance in disclosing the features of this concept. One of the issues that is constantly in the spotlight when studying issues related to the status of officials in international law is the issue of international crimes. This category of crimes is usually committed by heads of state or other state officials, and international legal acts on such crimes establish rules regarding whether these persons can be held criminally liable.
