[6] THE 7-TIER FRAMEWORK, CAPITAL OVER-INVESTMENT TRAP, AND SYSTEMIC DRIVERS IN INTENSIVE CARE UNITS (ICU): From Structural Overload & Forensic Log Auditing to the Disbursement Bottleneck Defense Strategy

Against the backdrop of financial self-autonomy mandates and the heavy amortization burdens of massive capital investments in high-tech medical equipment (ECMO, advanced mechanical ventilators, continuous renal replacement therapy systems), Intensive Care Units (ICUs) frequently experience severe structural capacity overload. Grounded in organizational sociology and modern risk governance frameworks established by Charles Perrow (1984), Sidney Dekker (2011), Michael Power (1997), Michel Foucault (1973), and Robert K. Merton (1940), this treatise formulates a "7-Tier Structural Model" to dissect the bi-directional dynamics between top-down reform policies and bottom-up financial pressures. It exposes how macro-level policies, initially intended for healthcare modernization, create operational gaps when under-resourced—whereby objective clinical and ethical standards (such as brain death criteria) risk being functionally operationalized by under-pressure institutions as practical mechanisms to liberate bed capacity. Furthermore, the study decodes semantic masking, capital equipment traps, and delivers an actionable defense manual for patient families, incorporating tactical verbal scripts, bailiff notary protocols (Formal Fact-Finding Records), independent device log forensics, and disbursement bottleneck strategies to neutralize non-clinical institutional pressures. Systemic Overload as a Driver of Clinical Errors and Legal Exposure: It is essential to clarify that objective clinical and bioethical standards—such as brain death criteria and organ donation frameworks—are intrinsically rooted in medical progress and humanitarian intent. However, when healthcare institutions operate under severe structural capacity overload and rigid financial self-autonomy mandates, operational compression and audit-anxiety significantly escalate the risk of systemic clinical errors, diagnostic compromises, and severe legal exposure for all stakeholders involved. For frontline practitioners, chronic systemic strain increases operational vulnerability and administrative non-compliance. For patient families, intense psychological pressure at the bedside risks inducing premature, legally disadvantageous decisions. Rather than attributing malicious intent to individuals, this study dissects these structural pathologies to provide an objective framework for risk mitigation, evidence preservation, and strict legal compliance in high-pressure clinical environments.
