The Concept of Commercial and Industrial Law by V.A. Udintsev and its Modern Interpretation
The relevance of the research topic is due to the debate that persists in Russian legal science regarding the model of regulation of economic relations and the relationship between civil and business law, as well as due to the lack of study of certain aspects of the pre-revolutionary controversy, in particular, the concept of commercial and industrial law by V. A. Udintsev and its potential for defining modern industry boundaries. The purpose of the study is to reveal the content and significance of V. A. Udintsev's doctrine of commercial and industrial law in the framework of the pre-revolutionary discussion on dualism and monism of private law, as well as to show its relevance for current theoretical scientific disputes about the structure of business law. The scientific significance of the work lies in V.A. Udintsev's in-depth study of the relationship between commercial and civil law, since the civilist not only stated the fact of their separation in certain historical periods, but also proposed his own concept of commercial and industrial law, which helps to better understand the evolution of private law and trace how modern approaches to regulating economic relations were formed. The scientific novelty of the research lies in the rethinking of V.A. Udintsev's doctrine, taking into account its internal evolution and in comparing its key elements with alternative approaches of pre-revolutionary civics. The results of the work make it possible to fill in historiographical gaps and enrich current theoretical developments by relying on detailed historical material.
