O Paradigma Restaurativo como Alternativa ao Punitivismo no Brasil
This article discusses the crisis in which the Brazilian penal system finds itself, with overcrowding in prisons, the harmful effects it produces, and the need to seek other responses to social conflict. In this context, it advocates breaking with the punitive paradigm and adopting a dialogic paradigm, replacing the retributive model with a restorative one, through Restorative Justice. It narrates its origins, the central precepts it postulates, and philosophical aspects, with the aim of bringing the parties to the conflict closer together, by suggesting the reunion of the victim and the perpetrator, in a dialogic rapprochement mediated by a public agent, with the participation of family members and members of civil society, aiming at reparation. It presents the development of Restorative Justice in Brazil, from the current regulations to the bills being processed in the National Congress and the work of the National Council of Justice, in efforts to contribute to a new model that reduces conflicts and protects human dignity.
