Violência doméstica e os limites do monitoramento eletrônico
Violence against women in Brazil, particularly femicide violence, has repeatedly shaped public debate in the state of Rio Grande do Sul, considering the increasing number of femicides recorded in recent years. In this context, one of the measures adopted by public authorities to prevent the killing of women is the use of electronic monitoring of offenders, with the aim of enhancing women’s safety and ensuring compliance with emergency protective measures. The article analyzes twenty decisions of the Court of Justice of the State of Rio Grande do Sul through documentary and jurisprudential analysis, in order to identify the situations in which electronic monitoring is applied, the prevalence of different types of violence, and the existence of judicial criteria for maintaining the measure or converting it into pretrial detention. The results indicate that electronic monitoring is applied predominantly in cases of psychological, moral, and physical violence; that offender recidivism is a decisive factor in the intensification of judicial responses, directly influencing the maintenance of the electronic ankle bracelet or its conversion into pretrial detention; and that electronic monitoring operates as a mechanism of initial risk management, without, however, preventing breaches of emergency protective measures, thereby revealing the limits of this technology as an instrument of comprehensive protection for women.
