Comparison of the Praxeological and Legal-Pragmatic Approaches to Understanding an Offense

This article is based on a comparative analysis of popular methodological approaches such as legal praxeology and legal pragmatism. The authors applied these theories to the conceptual definition of the term "offense." As a result, the article formulates the fundamental conceptual differences between these approaches. The formal dogmatic method and systems approach became the guiding methods of the scientific research. Separate specific scientific methods were also necessary to substantiate the results. Together, these methods enabled the authors to identify trends in the scientific understanding of offenses in Russian research. The main conclusion indicates the presence within the framework of praxeology of a comprehensive toolkit for assessing regulatory defects not only by measuring effectiveness, but also by identifying shortcomings in the active activity of law enforcement.
