The Theoretical Legal and Law-Enforcement Aspects of the Classification of Specific Administrative Offenses in the Sphere of Labor Migration

This article examines the theoretical, legal, and enforcement issues surrounding the classification of administrative offenses in the area of labor migration. The need to study the legal, social, economic, and technological aspects of labor migration is evidenced not only by numerous works in these fields but also by the law enforcement activities of state bodies, which result in the identification of foreign workers who conceal their employment, leading to the high latency of this group of administrative offenses. Only effective administrative and legal mechanisms for imposing administrative liability will contribute to the prevention of illegal acts in the area of labor migration. Law enforcement practice reflects problematic issues related to the implementation of legal norms in the area of labor for foreign citizens when imposing administrative liability. Undoubtedly, the effective management of migration processes, including labor migration, is a key objective of state migration policy, requiring a comprehensive legal approach. It is not advisable to limit ourselves to simply increasing the amount of administrative fines, which is the main type of punishment under these articles. What is important is to resolve administrative-tort issues and improve administrative-jurisdictional procedures for bringing to justice in the area of labor migration.
