This article provides a comparative legal analysis of administrative offenses that infringe upon public order and public safety in the virtual space of Russia and Tajikistan. It argues that virtual space possesses characteristics of a public space, but is not identical to it. The fragmentary nature of Tajikistan’s legislation is highlighted, and the authors propose adopting Russian experience to improve the Code of Administrative Offenses of the Republic of Tajikistan, taking into account the principles of legality and proportionality.
