PROTECTION OF HUMAN RIGHTS IN THE ADOPTION OF ADMINISTRATIVE ACTS: LEGAL GUARANTEES AND DIRECTIONS FOR IMPROVEMENT

The article analyzes the constitutional, administrative-procedural, and international legal foundations for protecting human rights and legitimate interests during the adoption of administrative acts. Legality, impartiality, proportionality, the right of an interested person to be heard, reasoned decision-making, and the opportunity to lodge an effective appeal are examined as interrelated safeguards. The scientific novelty of the study lies in systematizing these safeguards not as a set of separate requirements, but as a coherent mechanism of “participation — assessment of evidence — reasoning — review,” and in proposing practical criteria for evaluating the quality of administrative acts. The article puts forward proposals for clearly stating the legal and factual grounds of administrative decisions, providing individuals with understandable information about the procedure for appealing decisions, and applying uniform standards for providing reasons in administrative practice.
