Delegalization of political parties in the light of the Constitution of the Republic of Poland

Objectives This article aims to present the constitutional provisions relating to political parties within the Polish legal system, and to outline the prohibitions applicable to specific categories of political party. It also covers the legal framework and procedures governing their dissolution and removal from the register of political parties. Material and methods This study used a legal approach to closely analyse the Constitution of the Republic of Poland and the Act on Political Parties, which prohibit their activities. The research material included court decisions by the Constitutional Tribunal, laws, and important books and articles on constitutional law and political systems. The law created by the European Court of Human Rights (ECHR) is also important. It sets European standards for protecting freedom of association and says very clearly when a country's government can ban a political party. Results The methodological framework adopted made it possible to assess the compliance of national procedures with international standards and to define the democratic limits of state interference in the functioning of political parties. Conclusions The authors conclude that pluralism is not unlimited, however, and its implementation may be subject to restrictions.
