Judicial Review of Real-Property Auction Enforcement in Latvia: A Documentary and Doctrinal Case Study of Latgale Courts (2025–2026)

Abstract This research examines the effectiveness of judicial review and procedural safeguards in Latvian real-property auction enforcement, focusing on decisions of the Latgale District Court and Latgale Regional Court during 2025–2026. Based on a documentary compilation of judicial decisions, procedural complaints and supporting materials, the study critically evaluates discrepancies in cadastral identification, errors in statutory references, the legal significance of subsequent corrections, interim suspension of enforcement, access to judicial remedies, and the treatment of supplementary appellate submissions. The analysis considers Article 92 of the Latvian Constitution, Articles 6 and 13 of the European Convention on Human Rights, Article 1 of Protocol No. 1, and the conditional applicability of Articles 17 and 47 of the Charter of Fundamental Rights of the European Union. Particular attention is given to the distinction between formal availability of judicial remedies and their practical capacity to prevent potentially irreversible consequences. The study also examines judicial accountability, the legality of judicial composition, evidentiary standards, and the limits of conclusions that may properly be drawn from publicly available records. Research findings: The documented proceedings raise questions concerning the materiality of procedural errors, the adequacy of judicial reasoning, the treatment of evidence, and the practical effectiveness of interim protection. The available materials do not establish judicial corruption, criminal misconduct, or unlawful judicial appointments. Methodology: Documentary analysis, procedural chronology, doctrinal legal interpretation, and critical evaluation of competing legal arguments. Research status: Independent working paper. The findings are limited to the documents examined and do not constitute a judicial determination of wrongdoing. Author: Diks Ancveirs Publication date: 28 October 2026
