The Statute (Act) in the System of Sources of Domestic Law

Objectives The aim of this article is to analyze the statute (Act of Parliament) as the primary normative act within the system of universally binding sources of law in the Republic of Poland, with particular emphasis on its constitutional position, functions, and relationship to other sources of law. Material and methods The study employs the legal-dogmatic, historical, and descriptive methods. The analysis covers constitutional provisions, doctrinal views, the jurisprudence of the Constitutional Tribunal and the evolution of delegated legislation within the Polish constitutional order. Results The statute is a fundamental, primary normative act of a general and abstract nature, enacted by parliament in accordance with the procedure specified in the Constitution. The Polish legal system does not provide for organic statutes; consequently, all ordinary statutes carry equal legal force and are subordinate only to the Constitution and specific ratified international agreements. Conclusions The statute remains the foundation of the democratic state governed by the rule of law in Poland, playing a crucial role in regulating the rights, freedoms, and duties of the individual. The stability of the system of sources of law is further reinforced by the absence of a category of laws with intermediate legal force (organic laws) and the marginal significance of delegated legislation in constitutional practice.
