Penetapan Wali Hakim dalam Kasus Wali Adhol di Kantor Urusan Agama Kabupaten Jepara Tahun 2020-2025
This study analyzes the appointment of a judge guardian (wali hakim) in cases of recalcitrant guardians (wali adhal) at the Religious Affairs Office (KUA) in Jepara Regency (2020–2025). Using a qualitative descriptive approach and field research across KUA Kembang, Mlonggo, and Jepara, this study employs Lewis A. Coser’s conflict theory and structural-functional theory. The findings indicate that the appointment procedure follows a structured mechanism: administrative examination, clarification, family-based mediation, judicial referral to the Religious Court, and the execution of the marriage contract by the wali hakim. Causes of wali adhal are non-uniform, driven by underlying structural and interpersonal conflicts, including disparities in education level, economic instability, family breakdowns, and parental objections to the chosen partner. To resolve these challenges, the KUA performs a threefold role as an administrative body, a social mediator, and a legal educator. Consequently, the mechanism serves as a vital legal safeguard to protect women’s marital rights and resolve domestic power imbalances.
