Perlindungan Hak Restitusi Korban Pornografi Deepfake dalam Perspektif Undang-Undang Tindak Pidana Kekerasan Seksual

The improper use of artificial intelligence to create deepfake pornography raises questions about the legal basis of criminal liability and the restoration of victims’ rights. This paper attempts to examine the legal classification of synthetic pornography, the legal position of restitution, and ways to protect the victims in the criminal prosecution of such cases without resorting to the Law on Sexual Violence Crimes. A normative-doctrinal legal research method was used based on statutory, conceptual, and case approaches. The legal materials were studied in a qualitative manner with the descriptive-analytical method of research. Criminal law, the law on restitution, open-access scientific articles, and the 2026 case of the Semarang District Court were considered as research materials. As can be seen, the criminal offense element should be separated from the determination of the right to restitution. Victims' rights might be considered with the help of the Law on Sexual Violence Crimes, Witness and Victim Protection Law, and Supreme Court Regulation No. 1 of 2022, depending on their legal conditions. Based on open sources, it is impossible to tell whether the question of restitution was considered in the decision of the court.
