Denda Adat bagi Mempelai Laki-Laki yang Manyiriah dengan Berkendaraan di Nagari Koto Baru, Kecamatan Baso dalam Perspektif ‘Urf

The provisions governing customary fines in the manyiriah tradition in Nagari Koto Baru, Baso Subdistrict, need to be examined to understand their compatibility with the concept of ‘urf in Islamic law. This study aimed to analyze the practice of the manyiriah tradition, the provisions governing fines for grooms who use vehicles during its observance, and their assessment based on the concept of ‘urf. The study adopted a qualitative approach and was conducted as field research. Data were collected through interviews, observation, and documentation and then analyzed descriptively. The findings showed that manyiriah was performed before the marriage contract ceremony and baralek as a form of notification to customary leaders, religious leaders, and the community. Local grooms were required to observe the tradition on foot and seek permission from the mamak tungganai. Violations of the requirement to walk were subject to a fine of one bag of cement, which was used for community purposes. This provision served to maintain customary order, strengthen solidarity, and instill respect for customary authorities. Based on the ‘urf analysis, the tradition and its fine provisions were classified as ‘urf shahih because they were accepted by the community and deemed not to conflict with Islamic values. These findings indicate that fines in the practice of manyiriah constitute a mechanism for maintaining customary norms that, within the context of the local community, is considered compatible with the principles of ‘urf. This study contributes to understanding the relationship between Minangkabau custom and Islamic law in marriage practices, while opening avenues for further research into the origins of the fine provisions and the diversity of views on their application.
