Potential Electoral Fraud and Constitutional Accountability: Brazil's 2026 Presidential Runoff, Statistical Discrepancies and Judicial Intervention
This article investigates competing hypotheses concerning potential electoral fraud, constitutional accountability, and judicial intervention during Brazil’s presidential runoff of October 25, 2026. Combining documentary legal analysis with descriptive quantitative methods, the study reconstructs the national electoral results, compares pre-election opinion polls with official returns, examines changes in turnout and valid votes, and evaluates allegations involving vote tabulation and unequal electoral procedures. Particular attention is given to the judicial interventions involving Supreme Federal Court Justices Cristiano Zanin and Alexandre de Moraes, the separation of powers, proportionality, equal suffrage, and the constitutional limits of extraordinary judicial measures. The investigation distinguishes statistical discrepancies, procedural irregularities, intentional electoral manipulation, and demonstrable changes in voting outcomes. It also examines the reported approximately 34,330 votes cast after 5:00 p.m. in relation to the official margin of 4,430,191 votes, without treating aggregate numerical comparisons as proof of causality. The findings identify evidentiary requirements for electoral auditing, including precinct-level records, ballot-box reports, communication logs, and documentation of extraordinary voting procedures. The study concludes that concerns about electoral integrity and judicial accountability warrant transparent institutional scrutiny, while the available evidence does not establish electoral fraud or demonstrate that judicial intervention altered the election outcome.
