Implementation of Victim Protection Principles in Sexual Abuse Prosecution at the Bogor District Attorney’s Office
Ideally, sexual abuse prosecution should ensure criminal accountability while safeguarding victims’ rights and access to assistance. However, formal safeguards and the progression of cases do not necessarily demonstrate that victims’ protection needs have been fulfilled. This study aims to examine victim protection principles in prosecution at the Bogor District Attorney’s Office and identify institutional conditions affecting their implementation. It adopts an empirical legal approach combining legal analysis with interviews and accessible institutional and case documents. Qualitative analysis addresses communication about rights, confidentiality, psychological assistance, restitution, and inter-agency coordination. The analysis identifies the need to distinguish the availability of safeguards, their documented delivery, and their consequences for victims. Restitution requires separate assessment of information provision, claim submission, judicial awards, and payment, while coordination requires examination of referrals and follow-up. The study offers an integrated assessment framework. Clearer institutional responsibilities and case-level documentation are necessary to support an evidence-based evaluation of victim protection.
