Pertanggungjawaban Perusahaan atas Kegagalan Pemberangkatan Jemaah Umrah Perspektif UU PIHU

The provision of Umrah pilgrimage services requires accountability and professionalism from Umrah travel organizers (PPIU). However, cases in which organizers fail to arrange pilgrims’ departures continue to occur, resulting in both pecuniary and non-pecuniary losses. This study aims to examine and analyze the liability of Umrah travel organizers for such failures, identify the contributing factors, and assess the forms of legal protection available under Law No. 8 of 2019 on the Organization of Hajj and Umrah Pilgrimages, as amended by Law No. 14 of 2025. This study employs a normative legal research method with statutory and conceptual approaches. The legal materials comprise primary and secondary sources, collected through library research and analyzed qualitatively to draw systematic conclusions regarding the issues examined. The findings indicate that Umrah travel organizers that fail to arrange pilgrims’ departures must bear liability in accordance with Law No. 8 of 2019, including refunds and compensation, and may be subject to administrative and criminal sanctions where violations are established. Legal protection for pilgrims is provided through provisions governing the rights and obligations of Umrah organizers, government oversight mechanisms, and dispute resolution measures intended to ensure legal certainty and protect affected pilgrims.
