LAW ENFORCEMENT PRACTICE OF THE REQUIREMENTS OF ARTICLE 90 OF FEDERAL LAW № 123-FZ

The article considers topical issues of the legal regulation and practical implementation of the requirements of Article 90 of Federal Law № 123-FZ of July 22, 2008 «Technical regulations on fire safety requirements» with regard to ensuring the activities of fire departments at the present stage of urbanization. The author analyzes the regulatory provisions enshrined in Decree of the Government of the Russian Federation № 1479 of September 16, 2020 and in the codes of practice SP 4.13130, SP 8.13130 and SP 10.13130, which regulate the arrangement of fire passages, external stairs and fire-fighting water supply systems. Based on operational statistics and judicial practice materials, systemic law enforcement problems have been identified, including the conflict between the private interests of premises owners and public fire safety requirements, the blocking of passages, faulty hydrants and the non-compliance of access roads with regulatory parameters. The conclusion substantiates the need to revise control and supervisory mechanisms and to improve the regulatory framework in terms of eliminating gaps in the regulation of critical aspects of ensuring fire safety.
