RESEARCH NOTE 28 - XIX-C OTP - TRIAS POLITICA 3.0: MODEL-LEARNING CONSTITUTIONAL DEVELOPMENT
RESEARCH NOTE 28 — XIX-C OTP - TRIAS POLITICA 3.0: MODEL-LEARNING CONSTITUTIONAL DEVELOPMENT This research note examines the historical development of the differentiation of political powers and introduces TRIAS POLITICA 3.0 as a field-based model for studying constitutional development. Its central methodological proposition is: TRIAS POLITICA 3.0 MODEL-LEARNS THE DEVELOPMENT. MODEL-LEARNINGₒ designates the scientific activity through which unfolding constitutional configurations become readable in their differentiated positions, competences, responsibilities, institutional relationships and constitutive actions. The research traces selected historical developments from classical political thought and early modern constitutionalism to contemporary democratic institutions and international criminal justice. The distinctions TRIAS POLITICA 1.0, 2.0 and 3.0 are employed as provisional analytical readings rather than established historical periodisations. Particular attention is given to the independent judicial third instance and its KRINEINₒ: the capacity to discern, juridically qualify and decide within its assigned competence. The note further examines DIALOGUE >< ENDOLOGUE, distinguishing dialogue between conflict parties from the constitutive institutional presence of the competent judicial third instance. The contemporary configuration ICC >< FERP — BOTH IN DEVELOPMENT provides an exploratory field for investigating the differentiated development of international judicial competence and DOWN-TOP political representation. Throughout this investigation, FIELD CORRECTIONₒ remains operative, allowing the model's readings and formulations to develop with the encountered field. The research contributes to the continuing development of FESS/FHESS methodology and examines the relationship between scientific model-learning, constitutional differentiation and the emerging political representation project of the Field Endopolitical Representation Party (FERP).
