Reversión de la prohibición minera en El Salvador y el principio de no regresión.
In this essay, the principle of non-regression in environmental matters and its application in El Salvador were analyzed regarding the reversal of the metallic mining ban. Through a qualitative documentary analysis of regulations, jurisprudence, and recent doctrine (2006-2026), it was examined how this political decision contravened the standard that prevents States from reducing achieved levels of protection. The evaluation was carried out using the environmental regressivity test. The results demonstrated that the measure lacked technical justification and compromised water sustainability in the context of the climate crisis. It was concluded that the reversal constituted an unjustified normative regression that violated environmental legal certainty, intergenerational justice, and international human rights commitments.
