Reconstruction of the Regulation on Legal Protection of Suspects’ Right to Advocate Assistance in Criminal Case Investigation

Legal protection of suspects’ rights during criminal investigations is essential to a fair justice system that upholds human rights. One key protection is the right to legal counsel. In practice, however, problems persist, including interrogations without counsel, formalistic legal assistance, intimidation, and weak oversight of investigators. This study aims to analyze the construction of the regulation on legal protection of suspects’ right to advocate assistance in the criminal case investigation process and to formulate a more effective reconstruction of the regulation. Using normative legal research methods that combine statutory and conceptual approaches, this study examines primary and secondary legal materials. The results reveal that although various laws and regulations have established the right of suspects to receive legal aid, a number of deficiencies remain in their actual application. Reconstruction of the regulation is needed through strengthening the right to advocate assistance from the beginning of the investigation, giving advocates an active role, regulating the legal consequences of examination without assistance in certain cases, improving access to legal aid for underprivileged people, transparency of examinations through audio-visual recording, and strengthening oversight mechanisms and sanctions against investigators. Such reconstruction is expected to strengthen the protection of suspects’ rights, create a balance between the authority of investigators and the interests of suspects, and support the realization of a criminal justice system that is fair, transparent, and oriented toward respect for human rights.
