Qualification of NFT Tokens as an Object of «Other Property» in Disputes over the Division of Spouses' Property

The article conducts a formal-legal analysis of the legal status and classification of NFT tokens within the framework of Russian civil and family law. It substantiates the doctrinal development of the legal position of the Constitutional Court of the Russian Federation on digital currency as «other property» and its adaptation to NFTs in the context of the division of marital property, as well as the possibility of normative recognition of NFTs either as part of the category of «other property». The article proposes directions for improving legislation and harmonizing judicial practice aimed at protecting spouses’ digital property rights.
